Please read these terms carefully before using DFestival services and registering for programs.

Welcome to the official website of D Festival (the “Website”). These Terms & Conditions (“Terms”) govern your access to and use of the Website and any related services offered by D Festival, including (without limitation) program applications, competition applications, ticketing, registrations, communications, and online content (collectively, the “Services”).
By accessing or using the Website or Services, you agree to these Terms. If you do not agree, please do not use the Website or Services.
1) About D Festival
D Festival is a classical music festival focused on young pianists and related educational, performance, and cultural activities. D Festival may also offer competitions, masterclasses, workshops, lectures, concerts, cultural tours, media production, and other events.

2) Eligibility and Accounts
- You must be able to form a legally binding agreement to use the Services.
- If you are under the age of majority in your location, a parent/legal guardian must review and accept these Terms on your behalf and may be required to sign additional releases (especially for minors).
- If you create an account or submit a form, you agree that information you provide is accurate and that you will keep it updated.
3) Changes to These Terms and the Services
We may update these Terms from time to time. The “Last Updated” date at the top shows when changes were made. Continued use of the Website/Services after changes means you accept the updated Terms.
We may change, suspend, or discontinue any part of the Website/Services at any time (for example, schedules, faculty, repertoire requirements, venues, program formats, prizes, or event timing).
4) Program Applications, Admissions, and Participation
4.1 Applications
Submitting an application does not guarantee admission. We may request additional materials (recordings, documents, or verification).
4.2 Decisions
Admissions, casting, program placement, scheduling, and repertoire decisions are made at D Festival’s discretion, unless otherwise stated in writing.
4.3 Conduct and Removal
Participants must behave professionally and respectfully. We may remove any participant (without refund where permitted by law) for serious or repeated misconduct, including harassment, discrimination, threats, unsafe behavior, cheating, or damaging property.
5) International D Masters Piano Competition Terms
If you apply to or participate in the International D Masters Piano Competition (the “Competition”), you also agree to the following:
5.1 Rules and Eligibility
Competition rules (including age limits, repertoire requirements, rounds, tie-break rules, and judging criteria) will be published on the Website or official Competition materials. You are responsible for reviewing the current version.
5.2 Integrity and Fairness
- Any attempt to falsify identity, manipulate results, submit plagiarized or misrepresented recordings, or violate Competition rules may result in disqualification.
- D Festival reserves the right to interpret and enforce Competition rules in good faith.
5.3 Results and Prizes
Judges’ decisions are final unless D Festival states otherwise in writing. Prize details, taxes (if any), and payment timing may depend on sponsor availability, verification, and applicable law.
6) Fees, Payments, Refunds, and Cancellations
6.1 Fees
Application fees, tuition, tickets, and other charges (collectively “Fees”) will be shown at checkout or in official program materials.
6.2 Payment Processing
Payments may be processed by third-party providers. You agree to their terms as well. D Festival is not responsible for third-party payment outages or errors beyond our control.
6.3 Refund Policy (Template)
Unless otherwise stated on the specific program/ticket page, the default policy is:
- Application fees: non-refundable.
- Tickets: refundable only if the event is canceled by D Festival (or as required by law).
- Tuition/registration: refundable only according to the written refund schedule published for that specific program/season.
- No-shows / late arrivals: generally non-refundable.
6.4 Festival Changes
D Festival may change faculty, venues, schedule, repertoire requirements, formats, or other details due to artistic, operational, or safety reasons. These changes do not automatically entitle you to a refund unless required by law or explicitly promised in writing.
6.5 Force Majeure
We are not liable for delays, changes, or cancellations caused by events beyond reasonable control (for example: natural disasters, war, civil unrest, epidemics/pandemics, government restrictions, venue closures, power/network failures, strikes, or travel shutdowns). Refunds in these cases (if any) will follow the policy stated for the specific program/event and applicable law.
7) Travel, Visas, Insurance, and Personal Responsibility
Participants and attendees are responsible for:
- passports, visas, permits, and compliance with local laws;
- travel bookings and costs (unless explicitly covered by D Festival in writing);
- adequate health, travel, and instrument insurance.
D Festival is not responsible for personal travel disruptions, missed flights, visa denials, or lost/damaged personal belongings.
8) Health, Safety, and Accessibility
You are responsible for your own physical condition and readiness to participate. If you have medical needs, allergies, or accessibility accommodations, contact us as early as possible at dfestival.office@gmail.com so we can try to support you. Some venues may have limitations.
9) Photo/Video/Audio Recording and Media Release
D Festival events may be photographed, filmed, or recorded.
By attending or participating, you grant D Festival (and its partners, venues, faculty, sponsors, and contractors) permission to record and use your name, image, likeness, voice, performance, and biographical information for festival-related and promotional purposes worldwide, in any media, without additional compensation, unless prohibited by law.
If you are a minor, your parent/guardian may be required to sign an additional release.
If you have a serious privacy/safety concern (for example, protective orders), contact us in writing before the event at dfestival.office@gmail.com.
10) Intellectual Property
10.1 Our Content
The Website and its content (text, graphics, logos, photos, videos, designs, documents, and official materials) are owned by or licensed to D Festival and are protected by applicable intellectual property laws.
You may not copy, reproduce, distribute, sell, or create derivative works from our content without written permission, except for personal, non-commercial use.
10.2 Participant Materials
You retain ownership of your original materials (such as recordings, photos, bios, essays, or application content) that you submit, but you grant D Festival a non-exclusive, worldwide, royalty-free license to use them for evaluating your application and for festival/competition operations and promotion, unless you clearly opt out in writing where an opt-out is offered.
11) User Content Rules
If you post or submit content to the Website (comments, uploads, messages, etc.), you agree:
- you have the rights and permissions to submit it;
- it does not violate privacy, copyright, or any law;
- it is not defamatory, hateful, harassing, sexually explicit, or otherwise harmful;
- it does not include malware, spam, or deceptive content.
We may remove content at any time and may suspend access for violations.
12) Prohibited Use
You agree not to:
- hack, scrape, reverse engineer, or overload the Website;
- attempt unauthorized access to systems or accounts;
- use the Website to harass or threaten anyone;
- impersonate D Festival staff, faculty, applicants, or participants;
- misuse discount codes, application processes, or payment systems.
13) Third-Party Links and Services
The Website may link to third-party sites (venues, payment processors, sponsors, video platforms, etc.). We do not control and are not responsible for third-party content, policies, or practices.
14) Disclaimers
The Website and Services are provided “as is” and “as available.” We do not guarantee:
- uninterrupted or error-free operation;
- that information is always complete, current, or free of mistakes (though we try).
Artistic outcomes (admissions, casting, Competition results, performance improvement, prize awards) are not guaranteed.
15) Limitation of Liability
To the maximum extent permitted by law, D Festival will not be liable for indirect, incidental, consequential, special, or punitive damages, or for lost profits/revenue, even if advised of the possibility.
To the maximum extent permitted by law, D Festival’s total liability for any claim relating to the Website/Services will not exceed the amount you paid to D Festival for the specific Service giving rise to the claim (or USD $100 if you paid nothing), unless applicable law requires otherwise.
16) Indemnification
You agree to defend, indemnify, and hold harmless D Festival (and its staff, faculty, contractors, partners, sponsors, and venues) from claims, liabilities, damages, and expenses arising from your breach of these Terms, your misuse of the Services, or your violation of law or third-party rights.
17) Governing Law and Dispute Resolution
These Terms are governed by the laws of Hong Kong SAR and/or People’s Republic of China, without regard to conflict of law principles.
Any dispute, controversy, or claim arising out of or relating to these Terms or the Services (including their formation, validity, interpretation, performance, breach, termination, or enforcement) shall be governed by the laws of the People’s Republic of China (for the purpose of these Terms, excluding Hong Kong SAR, Macau SAR, and Taiwan).
The parties agree that any such dispute shall be submitted to the People’s Courts with jurisdiction in Quanzhou, Fujian Province, People’s Republic of China, and the parties consent to the exclusive jurisdiction of such courts, except where mandatory laws or regulations require otherwise.
Nothing in this clause prevents either party from seeking urgent interim or injunctive relief in any court with jurisdiction as permitted by applicable law.
18) Severability and Entire Agreement
If any part of these Terms is found unenforceable, the remaining provisions will remain in effect.
These Terms, along with any posted program rules, refund schedules, and policies referenced on the Website, form the entire agreement between you and D Festival regarding the Website and Services.
